01Acceptance and who provides the service
Berse (“Berse”, “we”) provides the service at berse.ai and operates from the United States. Contact: legal@berse.ai.
These terms, together with the privacy policy, the cookie policy and the Data Processing Agreement (DPA), are the contract between you and Berse. You accept them when you sign up and, when they change in a meaningful way, when you accept the new version. If you use Berse on behalf of a company, you accept them on its behalf and confirm you’re allowed to.
Some clauses distinguish between consumers (people who use Berse for purposes outside their trade or profession) and businesses or professionals. If you are a consumer, nothing in these terms limits the rights the law of your country of residence gives you that can’t be waived by contract.
02Service description
Berse lets you create, edit, publish and measure websites with the help of Cortex, our AI assistant, and connect them to services like Stripe, Resend or Google Maps. What each plan includes is described on the pricing page.
There are two kinds of site. Editable sites are created with Cortex and can also be edited by hand, in the visual editor (Design) and in Code. Sites made by Cortex (in beta) are built by Cortex like a programmer: it writes and runs their code in an isolated machine, shows you a live preview and works from what you ask in a chat, without a visual editor. The kind is chosen when you create the project and can’t be changed later.
Sites made by Cortex are in beta: they may change, have errors and have usage limits (for example, how many projects, how much preview time per day or how many publishes per day), and we may limit access, pause the creation of new ones or temporarily stop them to protect the service; what is already published stays online. Before installing a package or deleting files, Cortex asks for your permission. The beta is provided “as is”, with no availability commitments, and it may end or change shape; if we end it, we’ll give you advance notice where possible, what’s already published stays online and you can always copy your sites’ code from Code. Cortex’s work in the beta uses credits as explained in section 9. While it’s a beta, don’t rely on it as the only basis for something critical to your business.
We keep improving Berse, so its features may change. If we remove something essential from what you pay for, we’ll give you reasonable notice and, if it harms you, you can cancel and we’ll refund the unused part of what you paid in advance.
To publish, Berse uses its hosting provider and gives you a free address on berse.site; you can also connect your own domain. berse.site addresses belong to us: you can use them while your site is published on Berse.
03Account and eligibility
You must be at least 16 and give an email you control. When you sign up you represent and warrant that you are that age or older and can enter into this contract (or, if you’re not yet of age to enter into contracts in your country, that you have permission from your parent or guardian, who also accepts it on your behalf). If we learn an account belongs to someone under that age, we’ll close it.
Where it's available: Berse is not currently available to residents of the European Union, the European Economic Area or the United Kingdom. When you sign up you represent that you don't live in any of them. We don't direct the service to those regions and we block sign-ups and payments that come from there. If you access it from there by hiding your location (for example, with a VPN) or give false information about where you live, you do so at your own risk and we may close your account.
You’re responsible for what happens with your account and for keeping your password secure.
The details you give us must be accurate. An account is for one person: to work with others, invite them to your projects. Let us know if you think someone has accessed your account.
04Acceptable use
Don’t use Berse for: illegal content or content that incites hatred or violence; child sexual abuse material (we will report it to the authorities); misleading or fraudulent content, such as phishing pages, pages that collect passwords or payments under false pretenses, fake shops or impersonating people, brands or authorities; infringing others’ copyright, trademarks or privacy; collecting personal data without a legal basis; sending spam, including through forms; distributing malware, mining cryptocurrency or attacking systems; or selling illegal products or services, or regulated ones without the required licenses.
Nor may you: circumvent Berse’s limits, credits or security (for example, opening several accounts to get welcome credits, or trying to break out of the isolation of the machines where Cortex works); access others’ data or projects without permission; scrape our service or our providers’; use Berse or its output to develop AI models that compete with our providers’; or resell access to Berse without an agreement with us.
We apply usage limits to protect the service. If you see something that breaks these rules, tell us as explained in section 7.
05AI-generated content, photos and third-party services
Berse uses third-party AI models (OpenAI, Anthropic, xAI and Google) to generate and edit your sites. AI can make mistakes: the result may contain errors, inaccurate data, code or accessibility flaws, or similarities to existing material. Always review what matters (prices, contact details, legal text, claims about your business) before publishing it.
You decide what you publish and you’re responsible for it. Berse’s automatic checks (mobile, design, accessibility, the launch checklist) help, but don’t guarantee your site is correct, lawful or accessible.
The legal text templates Berse can create for your site (for example, a privacy page) are a starting point with markers to review, not legal advice.
Berse may suggest photos from Unsplash and Pexels and, if one doesn’t load, placeholder images from Picsum. They are governed by their licenses, which today allow free use, including commercial use and without asking permission, but don’t allow selling them as-is or compiling them into a similar service, and don’t cover trademarks, logos or works that appear in them or the image rights of recognizable people or places. Berse shows each photo’s author and license, but doesn’t guarantee the third-party rights in it: check its use fits your site, especially in ads or products.
The third-party services you connect (your Stripe or Resend account, Google Maps, your domain) are governed by their own terms, which you accept with them. Berse isn’t a party to those contracts and isn’t responsible for those services.
06Your sites and your business
You’re responsible for your sites and what you do with them: their content, complying with the laws that apply to you (consumer, e-commerce, advertising, data protection, accessibility, legal notices) and your relationships with your visitors and customers. If you sell with Berse, you are the seller: payments go to your Stripe account and Berse isn’t a party to those sales.
For your visitors’ data that Berse processes for you, the DPA applies (see section 17).
07Reports of illegal content and copyright
Anyone can report illegal or rights-infringing content on a site hosted by Berse by writing to legal@berse.ai with: the exact address of the content, why they believe it’s illegal or infringes their rights, their name and email (except in reports of child sexual abuse) and a statement that the report is made in good faith and is accurate. We’ll acknowledge it, review it diligently and objectively and tell the reporter what we decide.
US copyright (DMCA): notices under 17 U.S.C. § 512 must also include the physical or electronic signature of the owner or someone acting on their behalf, identification of the work and a statement, under penalty of perjury, that the information is accurate and the signer is authorized. Send them to our designated agent: Javier Lugo (Berse.ai), 3670 S New Hope Rd, Ste 4 PMB 1003, Gastonia, NC 28056, United States; phone +1 980 238 4116; email dmca@berse.ai (US Copyright Office registration: DMCA-1084102). If your content is removed by a notice and you think it’s a mistake, you can send a counter-notice meeting the law’s requirements; where appropriate, we’ll restore it within 10 to 14 business days unless the claimant tells us they have filed a court action. We will close the accounts of repeat infringers.
08Suspension and appeal
If content or an account breaches these terms or the law, we may act proportionately: remove or block that content, unpublish a site, limit features (for example, Cortex, sites made by Cortex or managed email) or suspend or close the account.
Before acting we’ll email you with the reason and a reasonable time to fix it, unless we must act immediately: clearly illegal content, a risk to the safety of people or systems, fraud, persistent non-payment or an order from an authority. In that case we’ll tell you as soon as we act.
We’ll always tell you what we did, why (the facts and the rule or clause applied), whether automated means were involved and how to challenge it. You can appeal by replying to that email or writing to legal@berse.ai within the following 6 months: someone other than the person who decided will review it and answer without undue delay, and if the decision was wrong we’ll reverse it. You can also go to the consumer authorities or the courts of your country.
During a suspension you can download your data, unless the law prevents it or it concerns illegal content. If we close your account for a serious breach, we won’t refund what you paid unless the law requires it; if we close it without you having breached anything, we’ll refund the unused part of what you paid in advance.
09Plans, credits and automatic renewal
The Free plan costs nothing: it includes credits every month and lets you create and publish one site on its berse.site address, with the “Made with Berse” badge, which you must not hide or remove while on Free. Paid plans add, depending on the plan, your own domain, the site without the badge, real payments with Stripe, more sites online at once, more Pulse days and features and more credits; what each includes is on the pricing page. Paid plans are bought monthly or yearly (the yearly plan costs the same as 10 months) and renew automatically at the end of each period, for the same term, charged to the card you have saved at your plan’s current price, until you cancel. Before paying you’ll see the price, how often it’s charged and how to cancel.
Prices are in US dollars (USD) on the pricing page; your bank may charge currency conversion fees.
Plan credits arrive every month (also on yearly plans) and the ones you don’t use expire at the end of that month, except on plans that say they roll over to the next month (at most one month of credits). Credit packs and welcome credits don’t expire and are used after the monthly ones. Welcome credits are given only once per person.
Credits measure AI usage and, on sites made by Cortex, machine time too: they aren’t money, have no value outside Berse and can’t be transferred or exchanged for money, except where these terms or the law provide for a refund. Each operation uses what it really costs: an estimate is reserved before it starts and what was used is charged when it ends. Operations that fail or don’t give a useful result don’t use credits, except as set out in the next paragraph.
On sites made by Cortex, the reserved amount may grow while Cortex works; if your credits don’t cover it, Cortex waits for you to add more (or for whoever shared the project with you to top it up) and, if they don’t arrive, nothing is saved or charged. What was used is charged when the work is saved. If you stop a request yourself after 2 minutes of work, what was used until then is charged, capped at the reserved amount, and we warn you before you stop it. Whatever fails on our side (the build, the machine, the AI provider or time) isn’t charged.
Live preview (of any site; the Design visual editor doesn't use it): it runs on a machine of its own and only active time counts (it pauses by itself when you're not using it). Each plan includes active time a month and a daily maximum, shown on the pricing page (on Free, time a day and with a confirmed email), and Studio shows what's left. At the limit, the preview pauses; only if the workspace's owner chooses to go on is active time past the limit deducted in credits at the price shown at that moment, until the period renews. Nothing is ever charged without that choice. Published sites, Design, Code mode and Cortex aren't affected. The work-hour equivalences we show (for example, “an active hour usually covers 2–3 h of work”) are estimates based on typical use and aren't part of what's included: what's included is the active hours. If we change these limits we'll tell you at least 30 days in advance, as with prices, and unused time doesn't carry over to the next period.
If you have a yearly plan, we’ll email you 15 to 30 days before each renewal with the amount and how to cancel. When you buy or upgrade a plan we email you its terms and, if your plan is monthly, we’ll remind you of them once a year.
If someone shares with you a project with credits set aside by its owner, you spend from those credits; whoever sets them aside is still the one who pays.
10Plan changes, pauses and promotions
When you upgrade, the new plan is charged in full today and a new period starts; the credits left from your previous plan are added to that period. If you move from a yearly plan to a more expensive yearly plan, only the difference for the rest of the year is charged. When you downgrade, or move from yearly to monthly, the change applies at the next renewal and you keep your current plan until then, without a refund of the difference.
A pause (of 1 or 2 months, when offered) stops charges; during it you get the Free credits and keep everything else, including your plan’s features. You can resume earlier, and then the plan is charged from that day.
Discounts and offers, including the Founder plan, have the conditions shown when they’re offered. For example, a retention discount lasts a limited number of months and can only be used once every 12 months, and the Founder plan price is kept while you stay on that plan but can’t be recovered if you leave it.
11Cancelling
You can cancel any time from Account → Usage & credits → Cancel subscription, online and without calling anyone. Before you confirm we may offer an alternative (a pause, a discount or a cheaper plan); accepting it is optional and you can always go on with the cancellation.
Cancellation takes effect at the end of the paid period: until then you keep your plan and afterwards you move to Free, keeping your projects, your published sites (they stay online, including with their domain) and purchased credits; what you do afterwards follows the Free terms (for example, the badge appears when you publish again and publishing one more site needs a slot in your plan). There’s no minimum term or penalty. You can undo it before the period ends with “Keep my plan”.
If you delete your account, the plan is cancelled immediately with no further charges; any remaining credits are lost and the current period isn’t refunded, except as set out in section 15 (right to cancel).
12Failed payments
If a charge fails, we’ll email you and our payment processor will retry it for a few days; meanwhile you can update your card from Berse. If it isn’t resolved, the plan ends and you move to Free, keeping your projects, your sites and purchased credits.
If you dispute a charge with your bank, we may pause paid features while it’s resolved. Write to us first: it’s almost always fixed faster.
13Taxes
If the law requires us to charge VAT, sales tax or a similar tax depending on where you are, we’ll add it and you’ll see the total before paying. If you buy as a business, you can add your tax ID in the billing portal, and the reverse charge will apply where relevant. Each party pays the taxes it owes by law.
14Refunds
Except as your country’s law requires (see section 15), all payments are final and non-refundable, including if you use the plan or the pack just once: cancelling doesn’t refund the current period and unused credits aren’t refunded in money. We will always refund anything we charged by mistake, such as a duplicate charge or a renewal charged after you cancelled in time.
To ask for a refund, write to legal@berse.ai. We refund to the same payment method (your bank may take 5 to 10 business days to show it) and remove the corresponding plan or credits from your account.
15Right to cancel a distance purchase
In some countries (for example, Brazil, Argentina, Chile, Colombia or Mexico), the law lets you cancel an online purchase within a few days. This is how it works at Berse:
1. Berse starts working as soon as you pay. So at checkout we ask you to confirm that you want to start right away, and we confirm it to you by email.
2. If you haven’t used anything you paid for yet, we refund everything. The same if you didn’t confirm that you wanted to start right away.
3. If you’ve already used it, even once (for example, one request to Cortex, one minute of live preview, one feature of your plan or one credit from the pack), there is no refund.
4. If your country’s law gives you this right even after you’ve used the service, we respect it: you can use it within the period it sets and we’ll refund what that law provides.
To ask for it, write to legal@berse.ai before the period ends, for example: “I cancel my contract for (plan or pack) bought on (date). Account name and email: (…)”. We’ll refund the amount within 14 days at most, to the same payment method and at no cost to you, and the plan or credits will be removed from your account.
16Price changes
We may change the prices of plans and packs; new prices apply immediately to new purchases. If you have a subscription, we’ll email you at least 30 days in advance and the new price will apply from your first renewal after that period; if you don’t agree, you can cancel before then at no cost. The credits you already have don’t change.
17Your data and privacy
For your data as a person who uses Berse, Berse is the controller and the privacy policy applies.
For the data of your sites’ visitors that Berse processes for you (hosting, Pulse, Forms, managed email, your sites’ files and images and the machines of sites made by Cortex), you are the controller and Berse the processor, under the Data Processing Agreement (DPA), which is part of these terms.
Portability: you can download a copy of your main data from your account and see and copy each site’s code from Code, including to take it to another service.
18Intellectual property
What you contribute (text, images, logos, data, requests to Cortex) remains yours. The output Cortex generates for you (your sites’ code and text) is also yours: to the extent we have any rights in it, we assign them to you. Bear in mind that in some countries AI-generated content without enough human input may not be protected by copyright, and similar output may be generated for other people.
You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, technically adapt, run, display and transmit your content only to provide the service: storing it, sending it to AI providers when you ask Cortex, building and running your sites, publishing them, making backups and supporting you. It lasts while your content is on Berse (and in backups until they roll over). We don’t use your content to train AI models or show it outside your sites without your permission.
You confirm you have the rights needed for what you upload, attach or ask us to read, including permission from people who appear in your photos. If you ask us to recreate a site as yours (“It’s my site”), you confirm it’s yours or you have permission; if you only use it as inspiration, you must not ask for its text, logos or trademarks to be copied.
Berse, Cortex, their software, design, trademarks and documentation belong to us or our licensors. These terms give you no rights in them other than using the service.
Some files Berse places in your sites are ours: the interface kit, the form, payment and map routes, and the other files marked “berse-managed”. We give you a worldwide, royalty-free, perpetual, non-exclusive license to use, modify and maintain them as part of your sites, including if you leave Berse. You may not distribute them separately or use them to build a service that competes with Berse.
Some sections and components of your sites are based on third-party open-source code under the MIT license (for example, Magic UI or Motion Primitives on sites made by Cortex). That code remains subject to its license: Berse adds its license notice to the project’s THIRD_PARTY_NOTICES.md file when it copies it and, when publishing, also publishes it on the site itself, at /third-party-notices.txt. Don’t delete it while your site uses that code.
If you send us ideas or feedback, we may use them freely, with no obligation to you.
19Availability and limitations
We do what is reasonable to keep Berse and your published sites available, but we don’t guarantee a specific level of availability. There may be interruptions for maintenance (we’ll try to keep them short and, if they are foreseeable and significant, tell you), because of our providers’ failures or because of usage limits we apply to protect the service.
We aren’t liable for failures caused by events beyond our reasonable control, such as widespread provider outages, attacks, disasters or acts of authorities.
Although we make backups, keep your own copy of what matters: you can download your data from your account.
20Warranties
We provide Berse with reasonable care and skill, but we can’t guarantee it will work without interruptions or errors, that generated content will be accurate or fit for a particular purpose, or that your sites will achieve any result. To the extent the law allows, Berse is provided “as is” and “as available”, without other express or implied warranties, such as merchantability, fitness for a particular purpose or non-infringement.
If you are a consumer, you keep your country’s statutory guarantees.
21Liability
Nothing in these terms limits our liability for death or personal injury caused by negligence, for willful misconduct or gross negligence, for fraud, or any other liability the law doesn’t allow to be limited.
If you use Berse as a business or professional, and to the extent the law allows: we aren’t liable for indirect damages or for lost profits, data, customers or business opportunities; and our total liability for all claims related to Berse is limited to the greater of: what you paid us in the 12 months before the event giving rise to it, or USD 100.
If you are a consumer, we are liable under your country’s law for foreseeable damage caused by our breach. We aren’t liable for losses that weren’t foreseeable or that relate to professional use of Berse.
In no case are we liable for third-party services you connect or for the content you publish on your sites.
22Indemnification
If you use Berse as a business or professional, you will defend and indemnify us against third-party claims, with their reasonable costs (including attorneys’ fees), caused by your content, your sites, your sales or your breach of these terms or the law. We’ll notify you of the claim, you can control the defense and we won’t settle on your behalf without your permission. If you are a consumer, you are liable only as your country’s law provides.
23Termination
You can stop using Berse and delete your account whenever you want. Deleting it cancels your plan, takes your sites offline and deletes your data as the privacy policy explains; download it first if you want it.
We may end the contract for a breach as explained in section 8. We may also stop offering Berse or end your contract without you having breached anything, giving you at least 60 days’ notice so you can download your data and move your sites; in that case we’ll refund the unused part of what you paid in advance.
Clauses that by their nature should survive (ownership, the license to Berse’s files in your sites, limitation of liability, indemnification, governing law) survive afterwards.
24Governing law and disputes
These terms are governed by the laws of the State of North Carolina (United States) and applicable US federal law, without applying their conflict-of-laws rules. If you are a consumer, this choice of law doesn’t deprive you of the protection of the mandatory rules of the country where you live.
The competent courts are the state or federal courts located in North Carolina. If you are a consumer, you can also bring claims before the courts of your country of residence where its law gives you that right. These terms contain no mandatory arbitration. The United Nations Convention on Contracts for the International Sale of Goods doesn’t apply.
Before any claim, write to us at legal@berse.ai: we’ll try to resolve it in good faith within 30 days. This doesn’t stop you from going to your country’s consumer authorities at any time.
25Changes to these terms
If we change these terms in a meaningful way, we’ll tell you by email or in Berse at least 30 days in advance and ask you to accept the new version before you keep using Berse. Changes required by law or security may apply sooner, and minor ones (typos, clarifications) when published.
If you don’t agree with a change, you can stop using Berse and cancel; if it harms you and you had paid in advance, we’ll refund the unused part.
Version history: 2026-10-25, first published version. If you ask, we’ll send you the earlier versions.
26Other terms
You may not assign this contract without our permission. We may assign it to whoever continues the service (for example, in a merger or sale), telling you and without reducing your rights.
Severability: if a court or competent authority holds that a clause of these terms is void, invalid or unenforceable, that clause will apply to the greatest extent the law allows or be replaced by a valid one as close as possible to its intent, and the rest of the terms will remain in full force.
Not exercising a right doesn’t mean waiving it.
We’ll send you communications at your account email or within Berse. These terms are in Spanish and English; both versions are equally valid and, if they differ, the version in the language in which you accepted them prevails.
27Contact
For any question about these terms, your subscription, refunds, cancelling a purchase or content reports: legal@berse.ai. We answer in Spanish or English.
